The lawyers for Chain Leader magazine contacted us and threatened us with legal action for copyright infringement if we continued to display their magazine on our site. [their magazine was located on this page in an Iframe]

Since we were presenting their site in its entirety without modification, since we were not claiming any of their work as our own, we believe that what we were doing was completely legitimate and was actually helping their business by exposing our readers to their magazine.

It is our opinion that we were not breaking any laws and that we were using this page to serve our readers while also providing a direct benefit to Chain Leader magazine.

Apparently, the people in charge of the magazine who also direct their legal resources don’t have any idea how the Internet works. Good luck to them in their pursuit to capture market share from online magazines like Nation’s Restaurant News with editorial policy like this.

We apologize to any of our readers who are used to coming here to read Chain Leader magazine. We also regret that we can not in good conscience provide a link to their site.

Some people just don’t have enough real work to do. Take for example The National Inhalant Prevention Council who have been angered by and are protesting the Wendy’s commercial where office workers ‘fill’ themselves with helium.

Supposedly the action of filling themselves with helium will give people ‘inappropriate’ ideas. Come one guys, let’s do something constructive with your time and money. Helium is an inert gas that is sometimes added to deep water diver’s breathing gas mixture. It doesn’t cause any ill effects, other than that annoying chipmunks sounding voice. While these people are all riled up against Wendy’s, there are real inhalant issues out there to deal with. Mostly they can be handled with education, because kids usually only hear the ‘good’ effects of and not about the death or brain damage that huffing can lead to.

As for the commercial, well I don’t like any of the new Wendy’s ‘wig’ commercials, but that is another story.

Cheese Pizza are now forced to submit ALL of the marketing plans and programs and explain how they ‘target’ kids and adolescents.

I don’t know about you, but I’m sick and tired of the government telling me "what’s best for me" and trying to legislate my "perfect life." What in the heck are they thinking up there? We don’t know that kids love ‘Happy Meals’, mice that sing, or toys with the french fries? Come on. Can we not find better things to do with our tax dollars than fund ridiculous investigations of the fast food industry and whether or not they are trying to sell more hamburgers to kids. If it were me, as CEO of one of the big chains, I’d say "Yep you caught us, we are trying, really hard to sell more hamburgers to kids! So now what are you going to do?" Wasn’t our country built on capitalism and the free enterprise system? Last time we tried communism here, wasn’t it William Bradford who discovered that it just doesn’t work.

Come on Washington, enough already. How ’bout spending your energy on something important like figuring out how to win the war on terror.

OK, where is the ACLU when you really need them? This is freaking ridiculous. The government in New York City has enforcing on restaurants some of the harshest laws regarding dietary content and labeling on menus and what restaurants can serve of any local government in the nation. They have outlawed the use of cooking oils containing trans fat and have put an onerous requirement for calorie and nutrition labeling on menus.

Now, supposedly in order to monitor the effectiveness of the ‘program’ they are collecting the receipts of diners to ’study’ their dining habits with the hope of influencing and changing the diners’ behavior to healthier habits. This is big brother gone wild. As much as I think lawyers are a big problem and that suing is not normally the answer, I think there needs to be a class action suit against these food Nazis. What do you think?

My friend the Recruiting Animal has challenged me to a duel, and he did it right out in the open, in front of all my peers. OK, I’m not sure that any of them want to be considered my peers, but heck he includes a bunch of noted Internet personalities along with me.

Just to bring you up to speed, The Animal is convinced that the recruiting bloggers have no influence. To that I say balderdash. Not only am I influencing the candidates and clients within the restaurant industry, but the influence of this blog has spread to at least two other industries (that I know of.) My article on customer service “What can broken eyeglasses teach us about customer service?” was made required reading by the manager of a call center (who just happens to be a resident of BC, a fellow countryman of the Animals’ and therefore a sterling source of evidence) that employs over 250 agents. And recently I found out that my article was featured in a prominent blog in the funeral industry – Final Embrace. So Animal, I can ask them for a discount for you after our grudge match on Wednesday.

For those of you who are interested, the radio show will air at 12 PM EST on Wednesday March 7th.

The Segment ID is 14974 and the call in number is (646) 652-2754.

I’m not sure when the pay-per-view will be scheduled, but I’ve heard that Animal is in discussions with DirectTV and OnDemand. Hope to see you there!

Now all I have to do if figure out 5 lucky bloggers who I think won’t mind typing their secrets in front of the whole world… THAT should be easy…LOL. OK, I know I sound frustrated, but it isn’t because I don’t like the game, I just can’t figure out what the heck to write. 5 things that people don’t know about me from my blog? And make it interesting? Geeesch, I don’t think I can come up with three things, heck two things… But in the spirit of the game, I’ll give it a try.

1) I graduated from the United States Naval Academy in 1980. Many people know that; however here is something most don’t know. Unlike my classmates, when I graduated I became a civilian because during my pre-com physical they discovered I had a kidney stone. Because I had gotten into the academy on a medical waiver after having a kidney stone removed, this second stone made a ‘history’ of stones and they determined me NPQ. So after half a million dollars spent educating me (some would say they didn’t do a very good job) the government decided that kidney stones are too dangerous a condition to allow me to serve. Your government and tax dollars at work!

2) I married my high school sweetheart shortly after graduating. After losing my first business (I was an entrepreneur at age 24) I got started in the restaurant business with my wife’s cousin. He also happened to be a professional gambler, and not the good kind that you see on TV today. The kind who ran big card games, football betting in the 5 figures, and the kind with a ‘enforcement’ crew who collected money for him. Never played in any games with him, but the bus boy at our restaurant was a 50 year old guy, 6′ 2″ 220 lbs named Frank, who had a crooked nose and had been with Lenny for 20 years…. you figure that out.

3) I won money in a card game and purchased my first Rottie – Thor, from a friend’s mom who was a backyard breeder. Didn’t get papers, didn’t get vaccine records, didn’t get squat except him. I was young and stupid and didn’t know any better. Thor got myocardial parvo and spent 7 days in emergency doggie care, but pulled through. Thor was a great dog. When I was unceremoniously informed by a lawyer one day 2 and 3/4 years after getting hitched that I should not go home and that my wife was divorcing me – Thor, my clothes, my TV, and my grand mother’s paintings were all that I took with me. (BTW Jules and I are expecting… our new Rottie is due to arrive in the first week of March.)

4) Julie, my wife of almost 22 years (March 2nd) and I met while we were in training at the Pizza Hut regional training center in Atlanta, Marietta to be exact. It was the most fun that either of us ever had at work. They put us up at the Marriot on Windy Hill Road and gave us $17 per day for food. Back then $17 was a LOT of money…LOL. Heck 32 ounce beers were only $1.90 in the bar. It was a vacation for us. If you know anything about the restaurant business, you would know that working from 8 to 5 everyday in a classroom, still getting your regular paycheck and spending money for food could be described as Heaven. We had lunch nearly every day in a little deli not far from the classroom. We pulled their picnic table in the parking lot so we could be in the sun and avoid some of the early spring chill. We usually had wine with lunch. Class was 2 weeks long and had about 35 people in it, some who had been with Pizza Hut for 10 years or more, and there were people at all levels. I was an assistant manager, but we had GMs, area supervisors and even and RVP designate. We had tests every day and a final exam on the last day. I was the class ‘valedictorian’ and Jules had the second highest grades. The RVP was third. I missed two questions out of all testing. At the time, it was the highest cumulative score that anyone had ever made. I had been with Pizza Hut for 3 weeks when I went to the class.

5) The recession of 2001 is when my partner decided to close down our company, UTA Business Systems, which was a major supplier of point of sale systems to the delivery industry. I had become partners with him because I needed an investor to take my company to the next level. I had started the company back in 1988 when I was working for a regional restaurant company while evaluating POS for our delivery stores, decided that there was nothing acceptable and that I could design something better. I worked for the restaurant company while at the same time I worked on the delivery software/hardware business (in my spare time ) It was devastating when the company closed, and a good friend of mine and I tried to buy the software for $2MM, but my ex-partner wouldn’t sell…. (asshole). So I ended up in the job search and finally becoming a recruiter. That part of the story is related in my post here which I wrote for Jason’s blog carnival. What most people don’t know is that I spent the next 9 months away from my family living in Atlanta by myself… and was just starting my second week of work when 9-11 happened. My family lived less than 10 miles from the Pentagon and I had worked in an office less than 2 miles from there. I had many friends who worked there as well as having been at the academy at the same time as the pilot of the plane that hit the Pentagon. It was a lonely time.

Ok, so now if you’ve gotten this far without falling asleep, here is where I’m supposed to tag some other folks. I don’t know anyone else besides Jason who has been tagged so I can’t point you to any of their blogs. But here is a list of folks that I’d like to learn more about. Some I know a little, some not very well at all, but I think they are interesting people none-the-less.

Dave Mendoza – Internet marketing expert, cybersleuth, and networking king. Dave is so busy writing about others on his blog (including me) that he doesn’t have much time to tell us his story.

Steve Levy – an old school recruiter with a great sarcastic wit. I love talking to Steve he is funny as heck.

Recruiting Animal -(name withheld in deference) whose blog is hilariously funny, even if outsiders to the recruiting blogosphere don’t have a clue of what he is writing about.

Amitai Givertz – a true gentleman whose extensive vocabulary falls short in signaling the depth of his experience. His blog is a great read.

Liz Strauss – an A list blogger who has been at it for so long that she may not have an secrets left to tell… but I thought I would challenge her. She was so helpful in helping get the word out on my Breast Cancer Public Service blog post .

That’s it for now. Hopefully these guys will write some entertaining stuff. I’m sure that they understand that they can take all the time they like during the holiday season to get their posts done.

Every year Recruiting.com holds an election of sorts to elect the best blogs in the recruiting blogosphere. No they aren’t the Academy Awards, but it would be nice to win none the less.

We were nominated by one of our readers (which is an honor in itself, thank you very much) to be included in the voting. You can go here to read the contest rules, or you can go directly to the voting. There are a lot of great blogs listed. I would be pleased if you would take a few seconds and vote for my blog. You also have the opportunity to vote for 4 other blogs. If you visit the blogs listed on my blogroll, I’m sure that you can find 4 other blogs deserving of your vote.

I can promise that if my blog wins, you won’t see me doing an acceptance speech like Sally Fields, but I will be grateful.

If the links don’t work for you, cut and paste this link into your browser: http://www.surveymonkey.com/s.asp?u=944023026614

Another sure sign that college tuition has gotten out of control: 19-year-old Ron Steen of Anaheim Hills, California put a share of his future earnings up for sale on eBay. In August, Steen offered two percent of his future earnings to the highest bidder. The cost? He set the minimum bid at $100,000. Steen, who claimed that he is “a very intelligent guy” despite the spelling errors in his eBay listing, also claimed in the listing that he expects to earn “way more” than $125,000 a year (didn’t we all when we were his age) until he turns 65, at which point his investor would break even on a $100,000 investment. Apparently, Steen hasn’t heard about the compound effect of money as I’m not sure too many investors would be lining up around the block to invest $100,000 or more into something as inherently as unsecured as a 19-year-old’s future earnings capacity and then have to wait 46 just to break even. Steen also apparently didn’t hear about eBay’s prohibition on such postings as eBay removed his posting five days after it went live. So what’s a desperately intelligent 19-year-old college student to do without the ability of selling two percent of his future earnings to someone who has more money in their wallet their brains in their head? What any normal 19-year-old does: he got his dad to fork over the cash. Steen’s dad is helping to pay the tuition at California State University at Fullerton until an investor shows up. If you’ve got more money than brains, Steen can be reached at mr.steen@yahoo.com.

I’m going to make an assumption that everyone knows who Michael Richards is, the guy who played Kramer on Seinfeld. If you haven’t seen the video of his meltdown at the Laugh Factory, or read any of the blogs discussing his awful behavior here are some links that you can follow: Integral Opinions Blog, cele | bitchy, and Webloggin’ – Blog.

It is clear from his behavior during the standup routine that he completely lost his cool. What isn’t clear is if he was under the influence of some substance that alters ones ability to control themselves. I would give you two quick pieces of advice that should help keep you from committing career suicide:

Caution: Video contains objectionable materialÂ

Click here to view the embedded video.

1) Don’t take substances which alter your mood. That means when you are in the public eye, don’t drink, or if you must drink do so with extreme moderation so that you don’t lose control of yourself. What you do or say in public can very easily effect your job. The company picnic, the Christmas party, the bosses birthday celebration – all opportunities for career meltdown if you lose control.

2) Don’t lose your temper. That means if you get mad, you need to get calm before saying anything to anyone. If it is a long term problem, then seek professional help. See a therapist, work with anger management programs so that you can control your emotions and respond in appropriate ways to stimuli that make you angry.

Now, I’m not in a position to judge whether or not Michael Richards is a racist. I’m not sure that there are very many people in the world who are. But I can tell you that his remarks were ugly and hurtful and no employer would allow those kinds of words to come out of an employees mouth without serious consequence. I can’t address the racist content of Michael Richards’ heart, and certainly not yours if you have any. But racism and racist speech is something that should remain out of sight and under control as you work to improve as a human being. I think racism is a terrible thing, and it isn’t acceptable behavior. If you harbor feelings that are like those expressed in loud, obnoxious screaming sessions by Mr. Richards, the very least you can do is protect your professional career by keeping those thoughts to yourself as you work with a therapist or your clergyman to learn to love your fellow man.
